Introduction 

Welcome to CYNOSURE Infotech (“Company”, “we”, “our”, or “us”). By accessing or using our website development and chatbot development services, you agree to comply with and be bound by the following Terms and Conditions (“Terms”). These Terms are governed by the laws of Ahmedabad, Gujarat (India). If you do not agree with these Terms, please refrain from using our services. 

 1. Services 

We provide website, presentations and chatbot development , digital marketing services tailored to your requirements. By engaging our services, you agree to: 

-Provide clear, complete, and accurate specifications for your project. 

-Respond to our requests for feedback or approval in a timely manner. 

-Understand that project timelines and costs are estimates and may vary due to unforeseen changes or additional requirements. 


2. Payment Terms 

A non-refundable deposit of 80% is required to commence work. Full payment is due upon delivery of the completed project unless a payment plan or milestone-based schedule is agreed upon. Late payments will incur an interest charge of 4% per month, and we reserve the right to suspend work on the project if payments are delayed beyond 7 days. Any additional costs due to changes in the project scope will be outlined and agreed upon in advance. 


3. Revisions and Scope Changes 

You are entitled to 1 rounds of revisions during the development phase. Requests for further revisions or major changes beyond the agreed scope will be subject to additional charges and could extend the project timeline. All revisions must be requested within 15 days] of delivery of each development phase. 


4. Intellectual Property Rights 

Upon final payment, ownership of the developed website, chatbot, and associated code will be transferred to you, unless otherwise agreed in writing. We retain the right to showcase non-confidential aspects of the project in our portfolio unless you request otherwise. Any third-party tools, libraries, or software used in the project will remain the property of their respective owners, and we will provide the necessary licenses as required. 


5. Warranty and Support 

We offer a 30-day warranty period post-launch to address any bugs or technical issues that may arise. Support after this period will be subject to a separate agreement. We make no guarantees that the website or chatbot will be error-free or that all potential issues will be discovered before launch, but we will work with you to address any issues within the warranty period. 


6. Limitation of Liability 

To the extent permitted by law, CYNOSURE Infotech will not be liable for any indirect, incidental, special, or consequential damages, loss of profits, data, or business arising from the use of our services, even if we have been advised of the possibility of such damages. 


 7. Termination 

Once a work order is confirmed, it cannot be canceled. Either party may terminate the contract by providing 15-days written notice. Grounds for termination include: Failure to provide necessary materials or feedback in a timely manner. Failure to make payments according to the agreed schedule. Breach of any terms of this agreement. Upon termination, you will be responsible for payment of all work completed up to the date of termination. 


8. Cancellation 

Cancellation of a work order is not permitted after confirmation. However, both parties may terminate the contract by providing a 15-day written notice. This notice must clearly state the reason for termination. Grounds for termination include: Failure to provide necessary materials or feedback within a reasonable timeframe. Failure to make payments according to the agreed schedule. Breach of any terms of this agreement. Upon termination, you will be responsible for payment of all work completed up to the date of termination.


 9. Governing Law and Jurisdiction 

These Terms and any disputes arising out of or relating to them shall be governed by and construed in accordance with the laws of Ahmedabad, Gujarat (India). Any legal action or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Ahmedabad. 


 10. Amendments 

We reserve the right to update or modify these Terms at any time. Any changes will be effective immediately upon being posted on our website. It is your responsibility to review these Terms periodically for updates.

 Refund Policy 

Effective Date: 20-11-2024

 At CYNOSURE Infotech, we prioritize customer satisfaction and strive to deliver top-quality services, including website creation, chatbot development, digital marketing, and consulting. However, due to the nature of our work, we have a transparent and fair refund policy to address any concerns. 

 General Refund Policy Guidelines 

Advance Payments: All our services require 100% advance payment. Refunds are subject to the specific terms outlined below.  

Non-Refundable Services: Payments for completed services are non-refundable due to the time, resources, and expertise invested in delivering the work. 

 Request Submission: Refund requests must be submitted in writing to [support email] within 5 calendar days of the service commencement or delivery. 

Service-Specific Refund Policies 

1. Website Creation 

      • Refunds will not be provided once the initial design concept is approved. 
      • If a refund is requested before the initial design concept is shared, up to 50% of the payment may be refunded. 
      • Refunds will not be issued for services that include third-party costs, such as domain registration or hosting. 

2. Chatbot Development 

      • Once the chatbot has been delivered or integrated into your system, no refunds will be provided. 
      • For canceled projects before delivery, a partial refund may be issued after deducting work completed, up to 50% of the total amount. 

3. Digital Marketing Services 

      • No refunds will be issued for ongoing or completed marketing campaigns. 
      • If a campaign has not yet started and the refund request is approved, we will deduct administrative costs and any third-party charges incurred. 

4. Consulting Services 

      • Fees for completed consulting sessions are non-refundable. 
      • For prepaid consulting packages, unused sessions may be eligible for a pro-rata refund upon request, provided the request is made within 5 calendar days of the first session. 

Conditions for Refunds 

Refunds will only be processed under the following conditions: 

  • The refund request meets the eligibility criteria outlined above. 
  • Proof of dissatisfaction or breach of service agreement is provided (where applicable). 
  • No intellectual property (e.g., website designs, chatbot scripts, marketing materials) created during the service is used or implemented after the refund. 


Non-Refundable Scenarios 

      • Failure to provide timely feedback or approvals necessary for project completion. 
      • Change of mind after work has commenced or been completed. 
      • Dissatisfaction due to reasons unrelated to the scope of work agreed upon. 

Processing Time 

      • Approved refunds will be processed within 14 business days. 
      • Refunds will be credited to the original mode of payment unless otherwise specified.
